1. Who we are and what these Terms govern
Synchronicity (the “Service”) is a web application providing personalised astrological content calculated from the user's natal chart. The Service is operated by Gabriele Maria Barba (the “Provider”), who may be contacted at support@synchronicity-sdg.com.
These Terms and Conditions (the “Terms”) govern access to and use of the Service. By using the Service, the user (the “User”) confirms that they have read, understood and accepted the Terms. A User who does not accept them must not use the Service.
2. Definitions
- Service: the Synchronicity web application, accessible through a browser and installable on a device's Home screen, including its current and future features.
- Content: text, scores, charts, interpretations, notifications and any other element generated or displayed by the Service.
- Stripe: the technical provider used to process payments and manage subscriptions.
3. Nature of the Service — entertainment and personal reflection
This is the most important section of these Terms.
3.1. Content is generated through astronomical calculations and a rules-based interpretive engine designed to be transparent and verifiable. Astrology is not an exact science: Content makes no claim to scientific validity and cannot predict future events.
3.2. Content is supplied solely for entertainment, inspiration and personal reflection. It describes symbolic qualities and tendencies, not facts or predictions.
3.3. Content never constitutes medical, psychological, psychiatric, legal, financial, investment, professional or other advice, and cannot replace qualified professional advice. Users must not make important decisions about health, money, work, relationships, travel or relocation solely on the basis of Content.
3.4. The User remains solely responsible for their choices and actions. The Provider does not guarantee that events, moods or circumstances described in Content will occur or match reality.
3.5. Content, including charts, interpretations and contextual qualitative layers, is for entertainment and personal reflection; qualitative layers do not change the Service's scores and are not evidence of effectiveness or accuracy.
4. Access requirements
4.1. The Service is restricted to people aged 18 or over. By using it, the User confirms that they are at least 18.
4.2. A compatible device, an up-to-date browser and an internet connection for first load and updates are required. Some features require JavaScript.
5. Submitted data, synchronisation and local storage
5.1. Before registration, profile data and preferences may be stored locally in the User's browser. The Provider cannot recover data that remains only on the device.
5.2. After sign-in, the astrological profile may be synchronised with Cloudflare D1 so it is available on multiple devices. Synced data is associated with an internal account identifier and processed under the Privacy Notice.
5.3. Clearing browser data, uninstalling the application or losing the device may permanently remove locally stored data. The Provider has no copy of data stored only on the device.
5.5. Clearing local data does not delete synced data. Reset removes the profile from the operational database, but does not automatically delete the identity held by the authentication provider, payment records that must be retained, or an active subscription. The Privacy Notice explains how to close an account completely.
5.7. The Privacy Notice is a separate document governing personal-data processing.
6. Plans, prices and payments
6.1. All current features are free for every user. No active trial or paid subscription is required. New purchases of the former monthly and annual plans are disabled. Advertising is currently disabled. Any future optional subscription will only remove all advertising formats, including rewarded ads, and will require a new voluntary purchase. Former subscriptions will not be reactivated automatically. Historical payments, invoices and rights for periods already paid are preserved; no automatic refunds are issued. If advertising is introduced during an already paid period, the user remains ad-free until that period ends.
6.2. Purchases are processed technically by Stripe. The Service contract is between the User and the Provider. Stripe processes payment data under its own terms and privacy notice.
7. Withdrawal and refunds
7.1. An EU consumer generally has a 14-day withdrawal right under applicable law. When requesting immediate access to digital content or services, the User expressly consents to immediate performance and acknowledges that the withdrawal right may be lost once supply begins, to the extent permitted by law.
7.2. Refunds are issued only when mandatory law or the Service's Refund Policy requires them and are processed through Stripe to the original payment method. A renewal not cancelled before it starts is not refundable for a period already begun unless mandatory law provides otherwise.
8. Licence and prohibited uses
8.1. The Provider grants the User a personal, non-exclusive, non-transferable and revocable licence to use the Service privately and non-commercially.
8.2. Users must not resell, sublicense, rent or distribute the Service or Content; decompile, disassemble or reverse engineer it except where mandatory law permits; scrape Content systematically or use it to train AI models; bypass technical or Paid Plan access controls; or use the Service unlawfully or in a way that harms its operation or security.
8.3. The Provider may suspend or revoke access after a breach, without prejudice to other legal remedies.
9. Intellectual property
9.1. The Service, calculation engine, text, graphics, Synchronicity mark and other elements belong to the Provider or its licensors and are protected by intellectual-property law.
9.2. These Terms transfer no intellectual-property rights to the User beyond the licence in section 8.
10. Availability, beta phase and Service changes
10.2. The Provider aims for reasonable continuity but does not guarantee uninterrupted or error-free availability. Maintenance, updates, technical causes or force majeure may cause temporary suspension.
10.3. The Provider may change, suspend or discontinue all or part of the Service. If the Service is permanently discontinued, unusable active subscriptions will be refunded pro rata for the remaining period.
11. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service is supplied “as is” and “as available”, without warranties concerning accuracy, completeness, reliability or fitness of Content for a particular purpose. Mandatory consumer guarantees and remedies for digital content and services remain unaffected.
12. Limitation of liability
12.1. To the fullest extent permitted by law, the Provider is not liable for indirect or consequential loss, lost profits, loss of locally stored data, or harm arising from decisions based on Content.
12.2. The Provider's total liability to a User will not exceed the amount actually paid by that User for the Service in the 12 months before the event, or any higher minimum required by mandatory law.
12.3. Nothing excludes or limits liability for fraud, gross negligence, personal injury or any other liability that law does not permit to be limited.
13. Changes to the Terms
The Provider may update these Terms for legal, technical or functional reasons. Material changes will be communicated with reasonable notice. Continued use after a change takes effect constitutes acceptance; a User who disagrees may stop using the Service and cancel an active Plan under section 6.3.
14. Governing law and jurisdiction
14.1. These Terms are governed by Italian law, without prejudice to mandatory rules in the consumer User's country of habitual residence.
14.2. Consumer disputes are subject to the courts of the consumer's residence or domicile where mandatory law so provides. Consumers may also use applicable alternative dispute-resolution procedures.
15. Final provisions
15.1. If one clause is invalid or unenforceable, the remaining Terms remain valid.
15.2. Failure to enforce a breach is not a waiver of the Provider's rights.
15.3. These Terms, the Privacy Notice and the Refund Policy form the entire agreement concerning the Service.
